Failing to plan is planning to fail. You’ve heard that one before. We’ve also seen it in action on many fronts. That’s why you can make it a Happier New Year by relying on solid planning, some smart thinking, and careful tracking of analytics to make it a winner of a 2022.


Build it and they will come. That’s the Field of Dreams mentality and it’s often true. Yet in a competitive sector such as transportation, it can be more fantasy than reality. Just waiting on business to come to you can be a tough road. It’s hard to get ahead without being proactive and scouring the marketplace for new business opportunities. Case in point among new avenues of revenue generation is contingent cargo. Just ask your major shipping contacts. They’ll more often than not demand it, making contingent cargo more than just a form of smart insurance protection but also a chance to create new business.

Meanwhile, motor carriers who add freight broker authority to their existing motor carrier authority are doing so for more than just compliance in cases where they may need to act on both sides of any shipping transaction. They’re doing so because it opens up new business opportunities. Most freight brokers and motor carriers have had to deal with the FMCSA forms that need to be completed for change requests. Forms such as the OP-1 and MCS-150 and MCSA-5889 all carry expiration dates at the top. If you submit a change request on an old form, you’ll be denied and required to use the correct form in order to get the request properly processed. Brokers can go to the FMCASA website to access the latest forms. Hansen gives fleet owners some suggestions as to how they can make the most of the new year ahead and it’s worth a quick read (whether you’re a motor carrier or any leading professional in the transportation industry).
Anticipating transportation and trucking legislation is an important part of being a successful freight broker, freight forwarder, motor carrier or just about any leader in the logistics industry. That means not only watching federal legislation but also monitoring “upward pressure” from states that want their say in how the industry operates in their jurisdictions. That’s why watching the trajectory of “Operation Open Road” could give a glimpse of where we’re heading on a number of fronts. The document – one part a call to action to the federal government and one part initiatives and regulations already in motion or being pushed at the state level – is being championed by 15 Republican Governors. John Kingston of FreightWaves takes a look at some potential trucking rule changes. 

Meanwhile, John Gallagher of FreightWaves profiles the White House’s $2 trillion “Build Back Better” infrastructure push and what it could mean for freight. Proponents believe it could ease the transition to clean fuels. 

Finally, it will be interesting to see where the Biden government’s vaccine-or-test-mandate is at in the opening weeks of the New Year. Not everyone is convinced it’s the right direction, including the American Trucking Association. In what could be an intense game of legal brinkmanship on the Emergency Temporary Standard, OSHA last month suggested that it will “not issue citations for noncompliance with any requirements of the ETS before January 10 and will not issue citations for noncompliance with the standard’s testing requirements before February 9, so long as an employer is exercising reasonable, good faith efforts to come into compliance with the standard”. OSHA said it will work closely with the regulated community to provide compliance assistance.
