POAA is grateful to every owner who contacts our Editorial Committee with feedback to the weekly newsletters. This week’s newsletter offers TeamPOAA’s business perspective of what is happening in the California, Illinois, Massachusetts, Ohio and Pennsylvania class action lawsuits against PF.
It is important for owners to know that the ongoing pandemic caused delays in the U.S. court systems, but POAA cannot say how that impacted the PF class actions, if at all.
In the CA, IL and MA class actions, PF and the named plaintiffs asked the Court for permission to amend their settlement agreement, and there are some procedural issues pending before the Court relating to that request. The class action lawsuits against PF in OH and PA were just recently filed and are still in the pleading process.
TeamPOAA will provide more substantive updates as soon as there is something to report.

TIP OF THE WEEK
Another Walmart Bulkmania promotion just ended, so Biscuit Division owners who provide DSD services to Walmart should calculate how much PF underpaid consignment sales commissions to pay for its latest nonsensical "trade promotion without trade spend". For owners who are unaware of this ongoing serious issue, PF stopped honoring its obligation to publish industry-standard Schedule B Bulletin Price Lists at the same time it started lowering the wholesale prices of 30oz Bulk GF varieties only for Walmart. Although the lower wholesale prices reflected on Walmart invoices are not reflected on our weekly Consigned Inventory Reconciliation Settlement Statements, do the arithmetic to confirm for yourself that PF pays owners approximately 5% less in consignment sales commissions based on the lower wholesales prices its charges to Walmart than for every other similarly situated retail chain. PF uses that cost-savings, in the words of former PF Executive VP Mark Schreiber, to "test" the efficacy of "trade promotions without trade spend".
